Texas Section 142 Trust Requirements
A 142 trust is a court-created trust authorized by Texas Property Code Section 142.005. A court of record with jurisdiction over the suit may establish one after determining that the arrangement serves the beneficiary’s best interests. It’s one possible structure for minor settlement proceeds, not an automatic requirement in every case.
Under the statute, the minor is the trust’s sole beneficiary. Depending on the approved terms, the trustee may make distributions for health, education, support, or maintenance. For a beneficiary who isn’t considered disabled under the applicable federal benefits standard, the trust may terminate at a stated age or no later than the beneficiary’s 25th birthday, subject to statutory alternatives and the court’s order.
The court retains continuing jurisdiction and supervisory authority after creating the trust. Texas law also addresses required trust language, trustee compensation, bonding, and the appointment of trustees that aren’t financial institutions.
