Paying proceeds directly to a claimant can create benefit eligibility complications that advance planning may avoid. Trust Options for Settlement Proceeds
The source of the assets is central to selecting a trust. Proceeds belonging to the claimant generally raise different issues from money provided by a parent, grandparent, or another third party. Potential trust arrangements include:
- First-party Special Needs Trust: Also called a (d)(4)(A) trust, this arrangement generally holds qualifying assets belonging to a person with a disability, including certain settlement proceeds. Federal and state requirements determine its availability and administration.
- Pooled trust: A nonprofit organization manages pooled investments while maintaining a separate account for each beneficiary. This option may be appropriate when pooled administration better fits the claimant’s circumstances.
- Third-party Special Needs Trust: Funded with assets belonging to someone other than the beneficiary, this trust serves a different purpose from a settlement-funded first-party trust.
- Settlement Preservation Trust: This structure may be considered based on the claimant’s benefits, settlement plan, and distribution objectives.
California Requirements for Special Needs Trusts
California planning must account for federal benefit rules as well as Medi-Cal requirements. A structure that works for one claimant may not suit another because eligibility can depend on the benefit program, trust terms, and the beneficiary’s age and administration. Qualified California trust counsel should review the proposed structure before proceeds are transferred.
Court procedures may apply in some cases. When a court hearing is required to create the trust, California Courts states that the trustee must notify the California Department of Health Care Services at least 15 days before the hearing. Trust counsel can determine whether court involvement or other notices apply to the settlement.
How Special Needs Trusts & CalABLE Accounts Differ
A CalABLE account is a tax-advantaged account that eligible individuals with disabilities can use for qualified disability expenses. It may be maintained alongside a special needs trust, but the two tools have different eligibility requirements, contribution rules, spending provisions, and treatment under Supplemental Security Income.
The appropriate approach depends on the settlement amount, expected expenses, desired control, and administrative needs. In some plans, the trustee manages trust distributions while the beneficiary uses a CalABLE account for eligible everyday expenses. Trust counsel and benefits professionals can assess how these tools may work together for a particular claimant.
